Werr Terms of Service
Welcome to Werr - a video-first travel platform designed to connect travelers with hotels, restaurants, and experiences, while empowering creators through commission-based monetization.
These Terms of Service ("Terms") form a legal agreement between you and Werr Ltd. ("Werr", "we", "us") and govern your use of:
- Our websites (https://werr.app and subdomains)
- Our mobile apps (Werr and Werr Pro)
- Widgets, APIs, dashboards
- Any other product or service that links to these Terms
(collectively, the "Services")
By using Werr — including browsing videos, creating an account, or clicking “Book Now” — you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
To use Werr, you must:
- Be at least 18 years old or the legal age in your country
- Not be prohibited from accessing our Services under applicable laws
- Only create one personal account (unless Werr approves a creator/business account)
2. Account Registration & Security
You agree to:
- Provide accurate, up-to-date info
- Keep your password confidential
- Be responsible for all activity on your account
If your account is compromised, notify us at hello@werr.app.
3. Content & Licenses
3.1 Your Content
Any videos, photos, captions, or other materials you upload or link from third-party platforms are "User Content".
By uploading, you grant Werr a worldwide, royalty-free license to use that content for the purpose of operating, promoting, and improving the Services.
If you delete your account, we’ll remove public access to your content in a reasonable time, but may retain backups for legal purposes.
3.2 Third-Party Embeds
Some videos embedded from platforms like TikTok or Instagram remain under those platforms' terms. Werr uses official embed policies and does not store those videos unless you've licensed them to us directly.
3.3 Creator Revenue Share
If you join Werr Pro, you may earn a revenue share (currently 50% of Werr’s net commission generated via your content). Additional Creator Terms will apply.
4. Bookings & Affiliate Links
Werr displays real-time booking options through partners like Booking.com or OpenTable.
When you click “Book”:
- You may be redirected to a partner site governed by their terms
- Werr is not the merchant of record unless stated
- Issues like refunds or cancellations must be handled with the booking partner
- Werr earns commission on completed bookings; if you’re a creator, your share will be calculated after taxes, chargebacks, or adjustments
5. Acceptable Use
You agree not to:
- Violate any law
- Upload illegal, hateful, misleading, violent, or pornographic content
- Infringe intellectual property
- Circumvent rate limits, security, or access restrictions
- Scrape, reverse engineer, or harvest data
- Use bots or fake identities to generate commissions
Violations may result in account removal or content takedown.
6. Intellectual Property
All content, code, and branding on Werr are owned by Werr or its licensors. You may only use them as allowed by these Terms.
7. Copyright & DMCA
To report copyright infringement, contact hello@werr.app with all required information under the DMCA (17 U.S.C. §512).
8. Disclaimers
- As-Is Services: We make no guarantees that video content, prices, or booking info are always accurate or current.
- Travel Risks: Werr does not inspect or endorse hotels or experiences. You travel at your own risk.
- No Warranty: To the extent allowed by law, Werr disclaims all warranties, including fitness for a particular purpose and non-infringement.
9. Limitation of Liability
To the fullest extent permitted:
- Werr is not liable for indirect damages, like lost profits or data.
- Our total liability is capped at £100 or the amount you paid us in the last 12 months - whichever is greater.
Some jurisdictions may limit these disclaimers.
10. Indemnity
You agree to hold Werr harmless from any legal claims or damages resulting from:
- Your content
- Your actions on Werr
- Your violation of laws or third-party rights
11. Dispute Resolution
- Governing Law: England and Wales
- Informal Resolution: Contact us at support@werr.app within 30 days to try and resolve the issue
- Binding Arbitration: If unresolved, disputes will be handled by LCIA arbitration in London, under English law
- No Class Actions or Jury Trials
Note: Some jurisdictions may override this with statutory consumer rights.
12. Termination
You may close your account any time via Settings or by emailing support.
We may suspend or terminate your access if you violate these Terms.
Sections like licenses, disclaimers, and arbitration will survive termination.
13. Changes to These Terms
We may update these Terms from time to time. If changes are significant, we’ll notify you by email or in-app at least 30 days in advance.
Your continued use after that date means you accept the new terms.
14. Legal Basics
- These Terms, plus our Privacy Policy, [Creator Terms], and [Community Guidelines] make up the full agreement
- If one part of these Terms is unenforceable, the rest still applies
- You may not transfer your account; Werr may assign rights as part of a business transaction
- Our failure to enforce a term is not a waiver
